1) By this Petition, the Petitioners seeks quashing of the F.I.R. vide C.R. No.0529 of 2023, registered with Nandgaon Police Station, Nashik, as against the Petitioners for the alleged offenes punishable under Sections 326, 323, 504 and 34 of the Indian Penal Code. 2) Learned A.P.P. for the Respondent No.3-State, on instructions, states that during the pendency of the aforesaid Petition, chargesheet has been filed qua the Petitioner Nos.1 and 2. 19. WP 1649-2024.doc Petitioner Nos.3 and 4 are concerned, sufficient evidence was not forthcoming and hence chargesheet has not been filed against Petitioner Nos.3 and 4. Statement accepted.
3) In view of the aforesaid, learned Counsel for the Petitioners seeks leave to withdraw the Petition, with liberty to file a fresh Petition, on behalf of Petitioner Nos. 1 and 2, seeking to challenge not only the F.I.R., but also the chargesheet and cognizance, if any, taken. 4) Accordingly, the Petition is disposed of with liberty as prayed. 5) We make it clear that we have not heard the parties on merits and keep open all contentions of all parties on merits.
