By this petition, the petitioner seeks transfer of investigation of C.R.No. 1076 of 2023 registered with the Hinjewadi Police Station, for the alleged offences punishable under Sections 306, 498A of the IPC.

Mr. Konde Deshmukh, learned Addl.P.P. submits that chargesheet has been filed in the said C.R. for the said offences on 18th Wakodikar 1/2
28-WP-1676-2024.doc June, 2024. Learned Addl.P.P. has tendered a report dated 20th August, 2024 evidencing the same. The same is taken on record. 3.
At this stage, learned Counsel for the petitioner states that the Police ought to have filed chargesheet also for the offences punishable under Sections 302 and 304B of the IPC. Since chargesheet has been filed, we do not wish to go into the same. 4.
Needless to state, that it is always open for the Court to invoke the said sections in the event a case is so made out by the prosecution. We make it clear that we have not gone into the applicability of the said sections, as sought. 5.
The petition is disposed of accordingly on the aforesaid terms.
