P.C.:- 1) Petitioner, wife of Respondent No.2 has invoked jurisdiction of this Court under Article 226 of the Constitution of India for quashing of C.R. No.0223 OF 2024 dated 30th January, 2024 registered with Kasarvadavli Police Station, Thane City, with the consent of Respondent No.2, the informant.
2) Learned Advocate for the Respondent No.2 tendered across the bar his consent Affidavit dated 4th July, 2024, duly affirmed before a Notary Public. It is stated therein that, there was matrimonial discord between them and the same has subsequently resolved by executing Consent Terms before the Family Court at Thane. ssm 10-wp2043.2024.doc Terms, he is giving his consent for quashing of the said crime in question. In paragraph No.9 thereof, the Respondent No.2 has given his no objection for quashing of the crime in question.
2.1) Respondent No.2 is personally present in the Court and through his Advocate reiterates the contents of his Affidavit dated 4th July, 2024 and his 'no objection' for quashing of the crime in question. 3) In view thereof, Application is allowed in terms of prayer clause (a).
