This petition is circulated by the learned counsel for the petitioner for speaking to the minutes of order dated 24th September 2024. He submits that in the third line of paragraph 1 of the order, inadvertently, the figure of arrears of maintenance is mentioned as 'Rs. 1,56,000/-' instead of 'Rs. 1,36,000/-'.

The order dated 24th September 2024 be corrected for IRESH MASHAL mentioning the correct figure as 'Rs. 1,36,000/-' instead of Digitally signed by IRESH MASHAL Date:

Learned counsel for the petitioner on instructions submits that the amount of Rs. 20,000/- is deposited directly to the respondent no. 1's account on 30th September 2024. He on instructions submits that the petitioner is agreeable to pay an amount of Rs. 4,000/- towards the maintenance for the minor child. He on instructions further submits that the petitioner shall continue to pay an amount of Rs. 4,000/- towards the interim maintenance for the daughter. He submits that as per the impugned order, the petitioner is directed to pay an amount of Rs. 8,000/- per month towards interim maintenance for the child from 29th March 2023. He submits that the petitioner shall clear the arrears towards the interim maintenance for the child at the rate of Rs. 4,000/- per month within two months from today. In addition to clearing the said arrears the petitioner agrees to continue to pay Rs. 4,000/- towards the monthly maintenance for the child. 5.

Statement made on behalf of the petitioner is accepted as an undertaking to this Court. The petitioner is permitted to pay Rs. 20,000/- by the end of this month and Rs. 22,000/- on or before 15th November 2024.

It is clarified that in addition to making payment towards arrears, the petitioner shall continue to pay Rs. 4,000/- towards monthly maintenance.

By way of interim arrangement, in addition to making the payment towards the arrears, the petitioner is permitted to pay maintenance for the child at the rate of Rs. 4,000/- per month. It is clarified that the said permission is granted without prejudice to the rights and contentions of both the parties. All the payments shall be made by directly transferring the amount to respondent no. 1's bank account.

Issue notice to respondent no. 1 alongwith copy of this order. Notice is made returnable on 10th December 2024. 9.

In addition to Court notice, learned advocate for the petitioner shall serve respondent no. 1 by private notice alongwith copy of this order and file affidavit of service before the next date. [GAURI GODSE, J.] 3/3
