1) By the present Petition filed under Article 226 of the Constitution of India, the Petitioner is seeking to quash N.D.P.S. Special Case No. 97 of 2002, arising out of C. R. No. 63 of 2002 registered with AntiNarcotic Cell, Mumbai. 2) Learned A.P.P. on instructions from the Police Officer attached to Anti-Narcotic Cell, Azad Maidan Unit, Crime Branch, Mumbai submitted that, the Petitioner was never arraigned as an accused in the said crime. That, Shankar @ Raju Ganesh Nadar, the principal accused in the said crime has been convicted by the trial Court by its Judgment and Order dated 15th December 2004.
