P.C.:- 1) By the present Petition filed under Article 226 of the Constitution of India, the Petitioner is seeking to quash N.D.P.S. Special Case No. 146 of 2001, arising out of C. R. No. 61 of 2001 dated 24 th September 2001 registered with Anti-Narcotic Cell, Mumbai. 2) Learned A.P.P. on instructions in writing from the Police Inspector attached to Anti-Narcotic Cell, Worli Unit, Crime Branch, Mumbai submitted that, the Petitioner was never arraigned as an accused in the said crime. That, Mr. Hiralal Bania was the sole accused in the said crime and by Judgment and Order dated 25th November 2022, the learned Judge of the Special Court was pleased to acquit him from the said case. 1/2
