1] Though we directed the Detaining Authority to file the Affidavit on or before 12.08.2024, there is no compliance. The learned APP Ms.Deshmukh informed the Court that though the draft of the Affidavit was forwarded to the Detaining Authority, the same is not yet received back.

2] By way of indulgence , we deem it appropriate to list the Petition on 23.09.2024, with a clear understanding that if the Affidavit is not filed, the pleadings shall be taken to be not traversed and if we are convinced with the grounds that are raised in the Petition and direct release of the Petitioner, it shall be with heavy cost being imposed upon the Detaining Authority.

Re-notify to 23.09.2024.
