The argument of the learned counsel appearing for the petitioner is, that the action under preventive detention shall be resorted to only when the ordinary laws of the country are insufficient to tackle the wrongdoer, and in this case to refect upon the past conduct of the detenu as bootlegger involved in several offences registered from the year 2018 to 2023 under the Maharashtra Prohibition Act, 1949, despite the offences being registered, he was never arrested. Reliance is placed upon the seven offences registered in the year 2023 in passing the order of detention. We specifically asked learned APP, Mr. Gavand as to whether in these offences the petitioner was arrested, he seek some time to obtain instructions. R.V.Patil
