By this petition, the petitioner seeks a direction to the Police of Alibag Police Station to register an FIR on the basis of the petitioner's complaint.

Learned APP, on instructions, states that the Police have Wakodikar 1/2

30-WP-2718-2024.doc recorded the petitioner's statement and thereafter, conducted a preliminary inquiry and accordingly, have to come to the conclusion that the dispute is of a civil nature. Accordingly, learned APP states that the Police will be closing the said complaint. 3.

In view of the statement made by the learned APP, learned Counsel for the petitioner seeks leave to withdraw the petition with liberty to file appropriate proceedings before the appropriate Court, in accordance with law.

Petition is accordingly disposed of as withdrawn with liberty as prayed.

Needless to state, that we have not gone into the merits of the petition and as such, all contentions of all parties are kept open. 6.
