Mr. Pujari, learned Counsel for the Petitioner, on instructions of the Petitioner, states that the Petitioner is ready and willing to deposit an amount of Rs.3,00,000/- before the learned Trial Court in three equal instalments. The said statements made by Mr. Pujari, learned Counsel for the Petitioner, on instructions of the Petitioner, are accepted as undertakings given to this Court. 2.
Issue notice to the Respondents, returnable on 23rd February 2026. In addition to the Court notice, the Petitioner to serve Respondent No.1 by private service and file Affidavit of Service before the returnable date.

The impugned Order dated 3rd January 2024 passed by the learned Judge, Family Court, Nashik below Exhibit-5 in Petition No.E-155 of 2020 is stayed on the following conditions : (i) The Petitioner deposits an amount of Rs.1,00,000/- in the Family Court on or before 16th February 2026. (ii) The Petitioner deposits an amount of Rs.1,00,000/- in the Family Court on or before 16th March 2026. (iii) The Petitioner deposits an amount of Rs.1,00,000/- in the Family Court on or before 16th April 2026. (iv) The Petitioner shall also deposit per month an amount of Rs.6,000/- in the Family Court till further Orders. The said amount shall be deposited on or before 10th day of each month. The first such payment to be made on or before 10th February 2026.
(v) The Respondent No.1 is at liberty to withdraw the amounts deposited from time to time.

It is clarified that said deposit and withdrawal is without prejudice to the rights and contentions of the Petitioner. 5.
It is specifically made clear that if there is any single default in depositing the above amounts, then the Writ Petition shall stand dismissed.

For reporting compliance of this Court, stand over to 23rd February 2026.
