In this case the investigation against the Petitioner is still in progress. We find some substance in the submissions of learned Counsel for the Petitioners that the offence under Section 498-A is not made out. As far as other offences are concerned, the investigation is still in progress.

At this stage, learned Counsel for the Petitioner does not press this petition but seeks liberty to adopt appropriate proceedings in accordance with law in case the charge-sheet is filed against the present Petitioner. He seeks permission to withdraw this petition with such liberty.
