By the present Petition under Article 226 of the Constitution of India and Section 482 of the Cr. P.C., the Petitioner has sought for the following substantive reliefs :
"B.
By issue of Writ of Mandamus and/or any Writ of directions and/ or any appropriate Writ and/or Order in the nature of Writ by exercising its inherent and extra ordinary powers delegated Under Article 226 R/w. Section 14 and 21 of the Constitution of India along with Section 482 of the Criminal Procedure Code, to quash and set aside F.I.R No.205 of 2024 registered by MIDC Police Station, Taluka Sinnar, District Nashik for the offences punishable U/s. 354, 323, 504, 506 R/w 34 of Indian penal code at the instance of Smt. Madhuri Ravindra Kolpe the Respondent No.2 on 04/05/2024,
against the Petitioners abovenamed on such terms and conditions as this Hon'ble Court may deem fit and proper. B(1). By issue of Writ of Mandamus and/ or any Writ of directions and/or any appropriate Writ and/or Order in the nature of Writ by exercising its inherent and extra ordinary powers delegated Under Article 226 R/w. Section 14 and 21 of the Constitution of India R/w. Section 482 of the Criminal Procedure Code (S.528 of Bhartiya Suraksha Sanhita, 2023) to quash and set aside F.I.R No.205 of 2024 registered by MIDC Police Station, Taluka Sinnar, District Nashik for the offences punishable U/s. 354, 323, 504, 506 R/w 34 of Indian penal code at the instance of Smt. Madhuri Ravindra Kolpe the Respondent No.2 on 04/05/2024, against the Petitioner abovenamed along with Charge Sheet filed in RCC No. 475 of 2024 pending before Ld. JMFC, Sinnar, Dist. Nashik on such terms and conditions as this Hon'ble Court may deem fit and proper.

By an order of this Hon'ble Court be pleased to direct the Respondent Police Station or Superintendent of Police, District Nashik to verify the correctness of the alleged incident held on 04/05/2024 as alleged in FIR No.205 of 2024 by considering the fact of assault committed by Respondent No.2 and five others on 02/05/2024 which is registered by FIR No.206 of 2024 on the basis of MLC No.190 dated 02/05/2024 registered by Respondent Police Station and file necessary report before this Hon'ble Court for quashing and setting aside the FIR No.205 of 2024 registered against the Petitioners abovenamed at the instance of Respondent No.2." 2.
Mr. Sanjeev Sawant, learned Advocate for the Petitioners on instructions from the Petitioner (Akash Dilip Shelar) craves leave to withdraw the present Petition with liberty to file an Application seeking discharge at an appropriate stage before the Trial Court. Mr. Sukanta Karmakar, learned APP for the State does not object to the request as made by Mr. Sanjeev Sawant, learned Advocate for the Petitioners.

In view of the above, leave granted to withdraw the present Petition
with liberty as above.

If such an application is filed before the Trial Court, the same be considered on its own merits in accordance with law. 5.
Writ Petition No. 3162 of 2024 is dismissed as withdrawn with liberty as prayed for.
