Learned appointed Advocate for the petitioner, on instructions of the petitioner, seeks leave to withdraw the aforesaid petition, since the petitioner is pursuing an alternative remedy i.e. has filed a bail application. Learned appointed Counsel for the petitioner also seeks liberty to file a fresh application, if the occasion so arises, seeking the very same prayers.

Learned Appointed Counsel has placed on record a photocopy of the letter sent to the Registrar of the Bombay High Court by the petitioner. The said letter is taken on record. 3.
Considering the aforesaid, the petitioner is permitted to withdraw the aforesaid petition with liberty as prayed. 4.
Petition is accordingly disposed of as withdrawn with liberty as prayed.

We make it clear that we have not gone into the merits of the petition, and as such, all contentions of all parties are kept open. 6.
