Learned counsel for the petitioners on instructions submits that the petitioner no.1 is ready to put an end to the dispute by exploring possibility of an amicable settlement with respondent no.1. He on instructions further submits that as per the impugned order, the amount of maintenance is already paid and petitioner no.1 is not in any arrears towards payment of maintenance. He further submits that the petitioner no.1 would continue to pay the monthly maintenance as directed by the impugned order. 2.

The statement made on behalf of the petitioner no.1 is accepted as an undertaking to the Court.

Learned counsel for the petitioners submits that considering the age of the minor son the petitioner no.1 is agreeable for an amicable settlement.

In view of the aforesaid submissions to enable the parties to make an attempt for an amicable settlement, I am inclined to issue notice to respondent no.1.

Issue notice to respondent no.1, returnable on 15th October 2024.

In addition to Court notice, learned advocate for the petitioners shall serve respondent no.1 by private notice alongwith copy of this order and file a service affidavit before the next date. (GAURI GODSE, J.)
