No. 212 of 2011, pending on the file of learned Judicial Magistrate First Class (Court No. 4), Pune has already commenced and as of today six witnesses have already been examined by the prosecution, this Court is not inclined to grant any relief as prayed for at such a belated stage.

1.1) In view thereof, learned counsel for the Petitioners on instructions seeks leave to withdraw the Petition with liberty to contest said R.C.C. No. 212 of 2011, before the trial Court. 1.2) Leave and liberty granted.
