Learned Counsel for the petitioner submits that since the petitioner is in Police custody for non-compliance of the order of maintenance, he is unable to make any statement with regard to payment of the arrears towards the maintenance as per impugned order.

Learned Counsel for the petitioner however submits on the instructions, that the petitioner is agreeable for one time settlement with the respondent no. 1. He further submits that the petitioner has 1/2

30-wp-3505-2024.docx been imprisoned till 9th September 2024. He further submits that once the petitioner is released, he will take necessary instructions with regard to payment towards the balance amount of arrears of maintenance.

Learned Counsel for the petitioner further submits that the petitioner be granted liberty to file an additional affidavit in support of the submissions.

In view of the aforesaid submissions made on behalf of petitioner that the petitioner is agreeable for an overall amicable settlement, issue notice to respondent nos. 1 and 2 returnable on 13th September 2024.
