1) Present matter was listed yesterday, i.e. 10th September 2024 for admission, when the following Order was passed. "1) Issue notice to the Respondent No.2, returnable on 22nd October 2024.
2) Learned Advocate for the Petitioner is directed to supply spare copies of the Petition in the Registry within a period of two weeks from today, failing which the Petition shall stand dismissed without further reference to this Court.
3) Till the returnable date, investigation of the crime to continue, however the Investigating Agency shall not file chargesheet without prior leave of this Court." 2) Subsequently, at 04.30 p.m., learned A.P.P. on instructions, 1/2
RVC 17 Wp-3536-2024.doc submitted that, in the present case Chargesheet has already been filed on 23rd July 2024 and therefore para No.3 from the said Order be deleted from record.
3) In view thereof, we had directed the Registry to list the Petition for hearing today.
4) In view the statement made by learned A.P.P., para No.3 of noted herein above, is deleted from the Order and the Order now reads as under :- "1) Issue notice to the Respondent No.2, returnable on 22nd October 2024.
2) Learned Advocate for the Petitioner is directed to supply spare copies of the Petition in the Registry within a period of two weeks from today, failing which the Petition shall stand dismissed without further reference to this Court."
