By the present Petition, the Petitioner has sought for the following substantive relief in terms of prayer clause (b) and (c):- (b) This Hon'ble Court may graciously be pleased to issue necessary order or directions in the like nature to quash the FIR No. and 430 of 2024 registered with the Park Site Police Station, the subsequent FIR in C R No. 51 of 2024 before the DCB CID X, preferred by the Respondent No. 2 both dated 31-05-2024 and the subsequent proceedings arising out of it pending before the Learned Additional Chief Metropolitan Magistrate 37th Court at Esplande Court, Mumbai against the Petitioner / Applicant be quashed and set aside;

(c) This Hon'ble Court may graciously be pleased to stay all the further proceedings arising out the FIR No. and 430 of 2024 registered with the Park Site Police Station, the subsequent FIR in C R No. 51 of 2024 before the DCB CID X both dated 31-05-2024 preferred by the Respondent No. 2 and the subsequent proceedings arising out of it pending before the Learned Additional Chief Metropolitan Magistrate 37th Court at Esplande, Mumbai against the Petitioner / Applicant during pendency of the hearing and final disposal of this petition / Criminal Application;

Mr. Chaitanya Kotnis, learned Advocate for the Petitioner, on instructions from the Petitioner, craves leave to withdraw the present Petition with liberty to file an Application seeking discharge before the Trial Court at the appropriate stage. 3.

Mr. Sukanta Karmakar, learned APP for the Respondent - State, does not object to the request made by Mr. Chaitanya Kotnis, learned Advocate for the Petitioner.

In view of the statement made by Mr. Chaitanya Kotnis and the no objection by Mr. Sukanta Karmakar, learned APP, leave granted to withdraw the present Writ Petition with liberty as prayed.

If an Application seeking discharge is filed before the Trial Court at the appropriate stage, same be considered on its own merits and in accordance with law.

In view of the above, Writ Petition No. 3538 of 2024 is disposed of as withdrawn.
