Pursuant to the order dated 26th November 2025, Mr. Kuldeep Patil, the learned counsel for the CBI has tendered information regarding documents mentioned in Criminal Writ Petition No.3632 of 2024 which were examined/collected during the course of Preliminary Enquiry. Another tabular chart contains a list of documents collected during the course of Preliminary Enquiry by bgp Page | 1
114.3631.24-wp.docx the CBI. The first chart contains 3 pages and goes upto serial no.15 and in respect of rejoinder affidavit it contains a reference of six documents. The chart containing list of documents collected during the Preliminary Enquiry goes upto serial no.52. Both are taken on record.

A similar chart in Criminal Writ Petition No.3631 of 2024 has been filed.

Mr. D. P. Singh, the learned senior counsel for the petitioner in Writ Petition No.3632 of 2024 referred to various documents including statutory records and the decision of the consortium of banks and contends that, no prima-facie case is made out for commission of offence punishable under sections 420 and 120-B of the Indian Penal Code and section 13(2) read with section 13(1) of the Prevention of Corruption Act, 1988.

Mr. Aabad Ponda, the learned senior counsel for the petitionercompany in Writ Petition No.3631 of 2024 has taken us through the contents of the First Information Report and made his submissions. One of the grounds for quashing of the First Information Report raised by the petitioner is that the First Information Report, after conducting Preliminary Enquiry, could not have been lodged against unknown directors of the petitioner-company and unknown bank officials. The learned senior counsel has also taken us through various documents at page nos.51 to 60 of the written submission to submit that the petitioner-company had substantial business prior to taking of loan.

The learned counsel for the CBI is seeking some time to produce a copy of the complaint made to the CBI, in a sealed envelop.
