Mr. S. A. Karmakar, APP for Respondent No.1-State. CORAM : A. S. GADKARI AND DR. NEELA GOKHALE, JJ.
DATE : 27th AUGUST, 2024.
P.C.:- 1) Present Petition is an example of sheer abuse of process of law by the Petitioner. Petitioner is informant in C.R.No.120 of 2023 registered with Nehru Nagar Police Station, Mumbai. The investigation of the said crime is completed and chargesheet has already been filed. 2) In these admitted set of facts, now the Petitioner wants to take 'U' turn on the ground that, he has settled the matter with Respondent No.2 and has filed present Petition for quashing of the said crime, which is legally not maintainable. From the conduct of the Petitioner, it is apparent that he set the criminal law in motion to bring the Respondent for settlement as per his demand and the lodgment of crime was used as a sophisticated tool to bring the Respondent No.2 for settlement. 1/2
