DATED : 9th SEPTEMBER, 2025 P.C. :- 1) This is a Petition for quashing of the F.I.R. registered at Wakad Police Station vide C.R. No. 1070 of 2023 dated 2nd November, 2023 under Sections 498-A, 504, 506 read with Section 34 of the Indian Penal Code, 1860.

2) Learned APP informed the Court that now the charge-sheet is already filed. Learned Counsel for the Petitioners submitted that the Petitioners have not yet been informed about filing of the charge-sheet. Learned APP produced a copy of the charge-sheet before us. We have 1/4

Manoj 2-WP-3814-2024.doc perused the copy of the charge-sheet. It is not necessary to refer to the allegations in detail because the parties have amicably settled the matter. In the beginning, the allegations in the F.I.R. are that, the Respondent No.2 got married with the Petitioner No.1 on 6th July, 2022. The Petitioner Nos.2 and 3 are the parents and the Petitioner No.4 is the sister of the Petitioner No.1. The F.I.R. refers to various allegations. It is mentioned that the Petitioner No.1 had obtained various amounts from her by way of dowry. He was short-tempered and used to ill-treat her. The other Petitioners supported the Petitioner No.1. In July, 2023 the Petitioner No.1 and Respondent No.2 had gone to USA, but there also there used to be quarrels between them. The Respondent No.

2 did not want to accompany him to some objectionable places. She wanted to come back to Pune to see her mother but the Petitioner No.1 tried to prevent her from coming to Pune. On 22nd September, 2023 the Respondent No.2 gave a notice for divorce through her Advocate addressed to the Petitioner No.1. After that, Petitioner No.1 got angry and threatened the Respondent No.2's family. On these allegations, the F.I.R. is lodged. The charge-sheet contains bank statements and statements recorded by the police. Those statements are given by the parents and brother of the Respondent No.2. They have supported the case in the F.I.R.

3) Now the matter is completely settled between the parties. The Respondent No.2 has filed an Affidavit. At present, she is residing at 2/4

Manoj 2-WP-3814-2024.doc Cayman Island. She had affirmed this Affidavit on 22nd July, 2025 when she has visited India to see her mother. It is mentioned in the Affidavit that she had initiated proceedings under Protection of Women from Domestic Violence, Act, 2005 as well as she had also initiated proceedings for divorce before the District Court at Pune. After that, the dispute was amicably settled between the parties and she has withdrawn the proceedings under the D.V. Act. Consent Terms are filed under the Marriage Petition. She has received Rs.6.5 Lakhs from the Petitioner No.1. The total promised amount in her favour was Rs.13,00,000/-. The balance amount is to be given to her at the end of the Marriage Petition. In this background, she has specifically stated in paragraph 5 of her Affidavit that she has no objection for quashing of the impugned F.I.R.

4) The Respondent No.2 appeared through V.C. She is identified by her Counsel appearing for her today.

5) Considering that the matter is completely settled between the parties, there would be no purpose served by continuation of these proceeding. Therefore, we are inclined to allow this Petition. Hence, the following Order :- :: ORDER ::

(a) The F.I.R. registered at Wakad Police Station vide C.R. No. 1070 of 2023 dated 2nd November, 2023 under Section 498-A, 504, 506 read with Section 34 of the Indian Penal Code, 1860 and 3/4

(b) Petition stands disposed of.
