This Petition was circulated in view of the ground mentioned in the praecipe dated 16th January, 2026.

By the present Petition, the Petitioners have sought for the following substantive relief :
"b) This Hon'ble may be pleased to quash and set aside the First Information Report (F.I.R.) bearing its C.R. No.
RC0592023A0003, registered with STB, New Delhi, however same being investigated By CBI STB, New Delhi and Special Crime Branch, at CBD Belapur, Navi Mumbai for an alleged offences punishable u/s 420 r/w 120(b) of IPC alongwith section 13(2) r/w 13(1)(d) and Section 7 (as amended) of Prevention of Corruption Act, 1988vide FIR dated 30.05.2023, lodged at the instance of present Respondent No.2 against the all the Petitioners, by exercising its inherent power as provided under section 482 of the code of criminal procedure."

Mr. Kunal Chheda, learned Advocate for the Petitioners submits that the request in the praecipe is to withdraw the Petition with liberty to file fresh Petition. He submits that pending the Petition, the Respondent No. 1 has filed charge-sheet as such the Petitioners intend to challenge the charge-sheet and file a composite Petition challenging the FIR impugned in the present Petition and the charge-sheet filed by the Respondent No. 1. 4.
Mr. Kuldeep Patil, learned Advocate for the Respondent No. 1 does not object to the request for withdrawal and the liberty as sought by the Petitioners.

In view of the above, leave granted to withdraw the Criminal Writ Petition with the liberty as prayed. At the request of Mr. Patil, learned Advocate for Respondent No. 1 all the objections to the
maintainability as also on merits in the event fresh Petition is filed are left open.

Criminal Writ Petition No. 3828 of 2024 is dismissed as withdrawn with the liberty as above.
