IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO. 3937 OF 2024 Dipak Sitaram Wagh ... Petitioner V/s.

The State of Maharashtra & Anr.

... Respondents Mr. Arjun Kadam for Petitioner.

Mr. Vinod Chate, A.P.P. for Respondent No.1-State. Police Sub-Inspector Mr. Venkat Pote, Wakad Police Station, Pune. CORAM : A. S. GADKARI AND DR. NEELA GOKHALE, JJ.

DATE : 11th September 2024.

P.C. :

1) This again is an offence against a woman, being investigated in a haphazard manner.

2) The Police Sub-Inspector Mr. Venkat Pote, attached to Wakad Police Station, Pune, is present in Court without the record of investigation so also the Case Diary. He is unable to answer the questions put to him and is giving irrelevant answers. We deprecate the practice adopted by P.S.I. Mr. Venkat Pote.

3) Upon a query by this Court, P.S.I. Mr. Venkat Pote, submitted that, the victim in the crime is not co-operating and therefore the investigation could not progress.

RVC 55 Wp-3937-2024.doc 4) We are appalled after hearing such a response. It appears from the reply that, the concerned officer wants the victim herself to investigate the crime and produce necessary evidence against the accused. 5) We are therefore left with no other alternate, but to direct the Commissioner of Police, Pimpri Chinchwad, Police Commissionerate, Pune, to file a detailed reply to the Petition.

5.1) This be done within a period of two weeks from today. 6) Stand over to 25th September 2024.
