Learned Counsel for the Respondent No.3 informs us that the order dated 9th October 2025 as well as the earlier orders have not been complied with by the petitioner. 1/3

In fact, despite giving directions to the petitioner to remain present before us today, he is not present. On an earlier occasion we were constrained to issue bailable warrant against the petitioner vide order dated 22nd September, 2025. 3.

Learned Counsel for the Respondent No.3 states that the petitioner has paid the sum of Rs.5,000/- to the Respondent No.3, as directed by us vide order dated 9th October 2025. 4.

At this stage, the learned Counsel for the petitioner seeks leave to withdraw the aforesaid petition seeking quashing and setting aside of C.R. No. 209 of 2024 registered with the M. R. A. Marg Police Station, Mumbai against the Petitioner for the alleged offences punishable under Section 406 and 420 of IPC with liberty to file a discharge application before the Trial Court. 5.

The petition is accordingly disposed of as withdrawn with liberty as prayed.

For wasting of the time of the Court and for not remaining present today despite there being an order to remain present, we direct to the Petitioner to deposit costs of Rs. 20,000/- with the respondent No.3. The said amount to be directly paid to Respondent No.3 in her account.

Stand over to 7th November 2025 for recording compliance of the payment of Rs.20,000/- by the petitioner to the Respondent No.3.

All parties to act upon on an authenticated copies of this order.
