24th SEPTEMBER 2025 P.C.:- 1) By this Petition under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, husband, mother-in-law, father-in-law and sister-in-law of Respondent No.2 have prayed for quashing of C.R. No.411/2024, dated 14th April 2024 registered with Chitalsar Manpada Police Station, Thane City, for the offences punishable under sections 406, 498-A read with section 34 of I.P.C., with the consent of Respondent No.2.

1.1) Mr. Mhaispurkar, learned counsel for the Petitioners submitted that, by an Order dated 20th September 2024, this Court had directed the Investigating Agency to continue with the investigation of crime, however it 1/2

Therefore chargesheet is not filed till today. 2) Mr.Thakkar, learned counsel for Respondent No.2 tendered across the bar an Affidavit of Respondent No.2 dated 24th September 2025, duly affirmed before the Deputy Registrar of this Court. It is stated therein that, due to mediation and reconciliation by the Court the matrimonial dispute between herself and Petitioner No.1 has been amicably resolved and Consent Terms are filled before the Family Court, Mumbai. Petitioner No.1 and Respondent No.2 have been divorced as per the Consent Terms filled before the Family Court, Mumbai. In paragraph-4 thereof Respondent No.2 has given her no objection for quashing of the said crime. 2.1) Respondent No.2 is personally present in the Court and through her Advocate, reiterates the contents of her Affidavit dated 24th September 2025 and her 'no objection' for quashing of the said crime. 3) In view thereof, Petition is allowed in terms of prayer clause (a).
