The present Petition seeks quashing and setting aside order dated 15th July 2024 passed below Exhibit 13 along with order of the same date framing charges below Exhibit No.10 passed by the learned Additional Chief Judicial Magistrate, 4th Court, Girgaon, Mumbai in C.C.No.389/PW/ 2021.

After advancing some arguments, Mr. Thorat, learned counsel appearing for the Petitioner seeks permission to withdraw the present Petition with liberty to assail the said order of framing of charges before the jurisdictionally competent Court, in appropriate proceedings.

Permission as sought is granted 4.

If such Application is made, the same shall be decided on its own merits in accordance with law without being influenced by withdrawal of this Petition.

It is made clear that, the period from the date of filing the present Petition till today shall be excluded from the period of limiation available to the Petitioner to assail the order before the jurisdictional competent Court. 6.

Accordingly the Petition is disposed off as withdrawn, with the aforesaid liberty.
