There are 3 accused persons who have been charge-sheeted by Ghatkopar police station for the offences under Section 420,406 r/w 34 of IPC. The present applicant is the first informant. Initially police have not taken cognizance and that is why first informant was required to approach the Court of then Metropolitan Magistrate, Vikhroli seeking direction under Section 156 (3) of the Code. When he was pursuing that remedy, the police have filed charge-sheet. In fact, the first informant has approached the Ghatkopar Police Station Corrected vide speaking to minutes order dt.17/9/25
LSP 2 21 wp 4213.24 spkg.doc for the first time in the year 2019. This application is filed only for issuing directions to the concerned Magistrate to expedite the trial. The grievance is the learned Magistrate has adjourned the matter for unnecessary long period and even the charge is not framed. The Applicant is the senior citizen. This can be evidenced from the record.

It is true that cases of senior citizens need to be given a priority. Instead of giving directions by this Court liberty can be granted to the Applicant to make a request before the Court which is seized of the matter because ultimately the Judge presiding over that Court is fully conscious of the pendency and priority to be given. If such a request is made, the learned Magistrate to decide the request as early as possible.
