By the present Petition, the Petitioner has sought for the following reliefs in terms of prayer clause (a), which read as under:- "(a) that this Hon'ble Court may be pleased to issue writ of certiorari and/or any other appropriate writ, order and/or direction in the nature of certiorari thereby calling for the records and proceedings concerning entire chargesheet arising out of C.R. No.I 287 of 2024 registered with Tulinj Police Station, Nalaspara (E), Dist.-Palghar and after examining legality thereof, may be further pleased to quash and set aside the same, in exercise of powers vested with this Hon'ble Court under Article 226 of the Constitution of India".

After having heard the matter for some time, Mr. Ravindra Mali, learned Advocate for the Petitioner, on instructions from the Petitioner, Sharada

42-WP-4350-2024.doc seeks leave to withdraw the present Petition, with liberty to file an application seeking discharge before the Trial Court at the appropriate stage.

Request made by Mr. Ravindra Mali, learned Advocate for the Petitioner, is not objected to by Ms. G. Mulekar, learned APP for the State.

In view of the statement made by Mr. Ravindra Mali, learned Advocate for the Petitioner, leave granted to withdraw the present Petition with liberty as prayed. If an application seeking discharge is filed before the Trial Court at the appropriate stage, the same is considered on its own merits in accordance with law. 5.
