The Petitioner is before this Court under peculiar circumstances. His name does not appear in the First Information Report (FIR) No.0148 of 2023, registered on 27th May, 2023 with the Shirgaon-Parandvadi Police Station, District Pimpri-Chinchwad. However, in the Remand Report, his name was mentioned on the basis of the information acquired from the accused persons. 2.

The learned Advocate for the Petitioner points out a statement on facts that was made by the learned APP on instructions from the I.O., before the learned Single Judge who dealt with Diksha Rane

909. WP 4431-24.odt Anticipatory Bail Application No.3370 of 2023. It is recorded in the order dated 31st January, 2024 in paragraph No.5 as under:- "5.

Today the investigating officer is present in the Court and is instructing the learned APP. On his instructions, learned APP has made a positive statement before the Court that there is no material against the present Applicant showing his direct or indirect involvement. Based on this statement, it appears that wrong submissions were made before the Sessions Court."

The learned APP submits on instructions from the I.O. Mr. Pawar present in the Court that there is no material noticed against the present Petitioner and there would be no observation about him in the charge-sheet.
