DATE : 17th JULY, 2025 P.C.:- 1) Mr. Patil, learned A.P.P. on instructions submitted that, the prosecution has filed an Application before the learned 24th Court of Judicial Magistrate First Class, Borivali, Mumbai, for committing the present case to the Court of Sessions. He fairly submitted that, even if Petitioner files an Application for committal, the prosecution will not raise any objection for the same.

2) In view of the above, Ms. Thakker, learned Advocate for the Petitioner on instructions, seeks leave to withdraw the Petition with liberty to file an Application for discharge before the trial Court. 1/2
