By this Petition, the Petitioner seeks quashing of the FIR registered at the instance of the Respondent No.2, bearing C.R.No.318 of 2024 with the Azad Maidan Police Station for the alleged offences punishable under Sections 3(5), 316(2), 318(2), 318(3), 318(4), 319(2), 335, 336(2), 336(3), 337, 338, 39, 340(2), 61(2) of the 1/2

8-wp4543-24.doc Bharatiya Nyaya Sanhita, 2023 (BNS), qua the Petitioner. 3.

Learned APP on instructions states that as of today, no material is found qua the Petitioner to show his complicity in the said case. He states that the main accused in the said case has not been arrested, as he is absconding.

Learned APP on instructions further states that since no material is found qua the Petitioner as of today, the Police will be filing a report under Section 189 of Bharatiya Nagrik Suraksha Sanhita, 2023 ( BNSS). Statement accepted. He states that the said report under Section 189 will be filed before the concerned Court within two weeks. 5.

In view if the statement made by learned APP on instructions from Mr.Sandesh Manjrekar, PI, EOW-7, Mumbai, nothing survives for further consideration of the Petition. 6.

The Petition stands disposed of.
