By this petition, the petitioner seeks a direction to the respondent Nos. 2 to 5 to register an FIR as against respondent Nos. 6 to 10 under the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act as well as under the provisions of the Bharatiya Nyaya Sanhita. 1/3

Mr. Konde Deshmukh, learned Addl. P.P, on instructions, submits that the police have conducted a preliminary inquiry into the petitioner's complaint and have come to the conclusion that no cognizable offence is disclosed and have accordingly, filed the petitioner's complaint. He states that the said decision has been communicated to the petitioner by post. Mr. Konde Deshmukh further assures that a copy of the said communication will be served to the learned counsel for the petitioner during the course of the day, since according to the petitioner, he has not received any communication. Statement accepted.

In view of the aforesaid, nothing survives for further consideration in the petition. Petition is accordingly disposed of. Needless to state that it is now open for the petitioner to adopt appropriate remedy as permissible in law before the 2/3

appropriate forum. Needless to also state that we have not gone into the merits of the petition and as such, all contentions of all parties are kept open.
