We have considered the submissions of the learned Senior Advocate on behalf of the Petitioner and the learned APP. We have perused the FIR No.69 of 2007 registered on 9th March, 2007. Prima facie, we are convinced that the Petitioner has made out an arguable case.

Issue notice to the Respondents, returnable on 26th February, 2025. The learned APP waives service of notice on behalf of Respondent No.1 State. This matter would appear in the "fresh admissions" category.

Until further orders, the appearance of the Petitioner before the Trial Court, is dispensed with and if a charge-sheet has been filed, the charge qua the present Petitioner, would not be framed.
