Mr Anand S Patil, for the Petitioner.

Mr AR Metkari, APP, for Respondent No. 2-State. SHEPHALI SANJAY MORMARE

CORAM:

ARIF S. DOCTOR, J DATED:

26th November 2024 SHEPHALI SANJAY MORMARE Date: 2024.11.28 16:53:51 +0530 PC:- 1.

The present Petition impugns an order dated 31st January 2022 passed by the JMFC, Islampur, District Sangli in Criminal Misc. Application No. 590/2017, by which the Application for maintenance filed by the Respondent (Wife) was allowed. Learned Counsel for the Petitioner submits that the said order was thereafter challenged before the Learned Additional Sessions Judge, Islampur along with Stay Application. That Additional Sessions Judge has, however, not hard and decided the Application for stay. It is thus the present Appeal is filed. It is his contention that Respondent No. 1 is a Gazetted Officer and drawing a salary of in excess of Rs. 1 Lakh per month. He submits that the order of maintenance to pay the Respondent a sum of Rs. 20,000/-

28-ASWP-4819-2024.DOC does not consider this aspect. It is for this reason, the present Writ Petition has been filed.

2.

Issue notice to Respondent No. 1, returnable on 7th January 2025.

3.

Learned APP waives service on behalf of the State. (ARIF S. DOCTOR, J)
