DATE : 12th NOVEMBER, 2025 P.C:- 1) Present Petition is filed for quashing of the subject FIR being registered by the complainant with Kalamboli police station, Navi Mumbai, has invoked the offence punishable under Sections 498, 406, 420, 504, 506 read with 34 of I.P.C.

2) When the matter is called out the complainant i.e. Respondent No.2 is present before us and she has tendered an affidavit of consent for quashing of the FIR.

The affidavit is signed by her on 12th November, 2025 but in absence of she being assisted by any counsel, she has not affirmed the affidavit.

3) Since, the complainant had filed the affidavit and under an assumption that she is according no objection for quashing the FIR. 1/2

We are informed that Petitioner Nos.2 to 5 are not the residents of Mumbai and it will be difficult for them to travel to the Court tomorrow. However, the complainant is agreeable that she will affirm the affidavit tomorrow, in the morning and an earnest request is made by her to take the Petition for hearing tomorrow.

Upon such request being made, we direct listing of the Petition on 13th November, 2025 at 3.00 pm but we do not insist upon the presence of the Petitioners during the course of hearing. 5) Let the affirmed affidavit be placed before us for consideration.
