By this petition, the petitioners seek quashing of the FIR registered vide C.R. No.1918 of 2023 with the Bandra Police Station, Mumbai, for the alleged offences punishable under Sections 409, 420, 34 r/w 120B of the Indian Penal Code ('IPC') ; Section 3 of the Maharashtra Protection of Interest of Depositors Act ('MPID Act') and Sections 4 and 13 of the Maharashtra Ownership of Flats Act 1/3

('MOFA').

Ms. Shinde, learned Additional Public Prosecutor, on instructions, states that during investigation it has transpired that no offence under the MPID Act, is made out. She, however, states that investigation is still on-going, only for the offences punishable under the I.P.C. and MOFA. She further states that investigation will conclude within six weeks from today and that appropriate report will be filed also within six weeks from today. Statements accepted. 3.

In view of the aforesaid statements made by the Additional Public Prosecutor, on instructions, learned counsel for the petitioners does not press this petition and seeks leave to withdraw the same, with liberty to file a fresh petition, if the occassion so arises, depending on the report that will be filed by the police.

Petition is accordingly disposed of as withdrawn with liberty as prayed.

We make it clear, that we have not heard the aforesaid petition on merits and as such all contentions of all parties on merits are kept open.
