Mr. Kadam, learned Counsel for the Petitioners, on instructions, states that, he has no objection for exhibiting the documents by the trial Court, however, as the documents have been exhibited post its production pursuant to a call for the same during the course of the cross-examination, the Petitioners be allowed to further cross-examine PW-1 in relation to those documents. He further states that, the Petitioners undertake to cross-examine the said PW-1 on the due date i.e., 18th December, 2024. Further, Mr. Kadam, the learned Counsel requested that immediately after the cross-examination of PW-1 is closed, the Petitioners be allowed to file an Application seeking cancellation of a non-bailable warrant issued against them and for recording their statements under Section 313 of Cr.P.C.
2) Learned Advocate Mr. Jatin Shah for Respondent No.2 states that, he would produce the said PW-1 before the trial Court tomorrow i.e., 18 th 1/2
P.H. Jayani 38 wpst25048.2024.doc December, 2024 and he has no objection for cross-examination of PW-1. Further, he states that, he will give no objection to the said Application seeking for cancellation of non-bailable warrant and recording of statements under Section 313 of Cr.P.C..
3) The aforesaid statements by the learned Advocates, are accepted as an undertaking to this Court.
4) In view thereof, all the contesting parties shall attend before the trial Court on 18th December, 2024.
5) Stand over to 19th December, 2024.
