By the present Petition, the Petitioner has sought for the following substantive relief :-- "(b)This Hon'ble Court may be pleased to quash and set aside the proceedings in R.C.C. No.253/2017 pending before the 7th Joint Civil Judge Senior Division (Jt. C.J.S.D.) and Additional Chief Judicial Magistrate (Addl. C.J.M.), Vasai, along with the FIR and charge-sheet arising out of C.R. No.489 of 2016 registered at Waliv Police Station for offences punishable under Sections 385, 500, 504, 506 and 509 of the Indian Penal Code (I.P.C.), read with Sections 3 and 25(1)(A) of the Arms Act, lodged by Respondent No.2/Informant."

After having argued the matter for some time, Mr. Aniket Nangare, learned Advocate for the Petitioner, on instructions from the Petitioner, craves leave to withdraw this Writ Petition with liberty to file an application for discharge before the trial Court at the appropriate stage. 3.
The request is not objected to by the learned APP for the Respondent/State.

In view of the statement made by Mr. Aniket Nangare, learned Advocate for the Petitioner, leave to withdraw this Writ Petition is granted with liberty as prayed for. If any such application seeking discharge is filed before the Trial Court, the same be considered on its own merits and in accordance with law.

The Writ Petition No.5572 of 2024 is disposed of as withdrawn.
