Mr. Sarwate, learned Counsel appearing for the Petitioner, states that the challenge in this Criminal Writ Petition is to the Order dated 29th February 2024 passed by the learned Principal District Judge, Pune, in Criminal Misc. Application No.380 of 2023 which has been filed under Section 408 of the Code of Criminal Procedure, 1973, seeking transfer of the DV proceedings being Criminal Misc. No.5143 of 2014 from the Court of learned JMFC, Court No.9 to any other Court.

65-WP-5596-2024.doc However, he states that the concerned Court has been transferred and, therefore, seeks withdrawal of the Criminal Writ Petition. 3.

Accordingly, the Criminal Writ Petition is allowed to be withdrawn and dismissed as such.

In view of dismissal of the Criminal Writ Petition, nothing survives in the Interim Application and the same is also disposed of. [MADHAV J. JAMDAR, J.]
