Heard learned counsels for the respective parties. 2.
At the outset, learned Senior counsel for the Petitioner seeks leave to amend the prayer clause. Leave to amend is granted. Amendment to be carried out forthwith. 3.
By this Petition, the Petitioner seeks (i) defreezing of the Petitioner's savings bank account with ICICI Bank, 1/3
Ahmedabad Branch, Gujarat and (ii) seeks handing over of the Petitioner's locker by the Respondent - CBI to the Petitioner. 4.
Mr.Patil, learned counsel for the Respondent - CBI on instructions states that investigation is still in progress and as such at this stage the Petitioner's bank account should not be de-freezed, since investigation is pending.

In view of Mr.Patil's statement, learned Senior Counsel for the Petitioner does not press the said relief i.e. seeking de-freezing of the Petitioner's account. He however seeks liberty to file a fresh Application / Petition, as soon as charge-sheet is filed. Accordingly, the aforesaid prayer seeking defreezing of the account is disposed of, as not pressed with liberty to file a fresh Application / Petition, once charge-sheet is filed. 6.
As far as the second relief is concerned i.e. (ii) of handing over of locker No.25 with the ICICI Bank, Ahmedabad Branch, Gujarat, learned Senior Counsel for the Petitioner states that the CBI had opened the said locker and seized all the articles found in the said locker i.e. documents and Rs.1,00,000/- cash 2/3
and as such presently the locker is empty.

Mr.Patil, submits that the Respondent - CBI does not dispute the same i.e. that certain documents and Rs.1,00,000/- cash was seized from the Petitioner's said locker and that at present there is nothing in the said locker. He further on instructions states that he has no objection if the Petitioner is permitted to operate locker No.25. He states that keys of the said locker will be handed over to the Petitioner within one week from the date of uploading of the order. The said statement is accepted. 8.
In view of the aforesaid, nothing survives for further consideration in the Petition. The Petition stands disposed of accordingly.
