The challenge in the present Petition is to an Order dated 22 nd October, 2024, passed by Judicial Magistrate First Class, Solapur in an Application filed by Respondent No.3 (who is sister-in-law of Petitioner No.1 and daughter-in-law of Petitioner No.2). The Trial Court has by the Impugned Order ordered and directed Respondent No.3 to take possession of flat in which the Petitioners reside.

It is submission of Learned Counsel for the Petitioners that the Petitioners were not even made parties in the proceedings before the Trial Court and got to know of the Impugned Order only when Respondent No.3 came to Shubham 1/2

2 21-WP-5983-2024.doc take possession of the said flat accompanied by certain social activists. It is thus that the present Petition has been filed.

Hence, issue notice to the Respondents returnable on 28 th January, 2025.
