The Petitioner is challenging the order passed by the learned City Civil and Sessions Court, Greater Mumbai, in Criminal Miscellaneous Application No.2510 of 2023, wherein the delay of 439 days in filing the Appeal against the order passed by the Metropolitan Magistrate, Court at Bandra, Mumbai, has been challenged.

By order dated 12th February, 2025, the Petitioner had sought for time to produce copy of the delay condonation KARTIKEYA
24-WP-6027-2024.odt Application. The Petitioner has filed miscellaneous application, wherein he has produced on record copy of delay condonation Application. After going through the reasons given in Paragraph No.6 for the delay caused in filing the Appeal, it is evident that apart from the financial crunch, the Applicant has also stated that since his mother is a Senior Citizen and was suffering from a certain medical ailments, he could not approach the Court.

In view of the averments made in the Petition, issue notice to the Respondent No.2, returnable on 8th July 2025. 4.
Mr. Patil, the learned APP waives service of notice on behalf of Respondent No.1-State.
