Petitioner husband is challenging maintenance order passed under Section 125 of the Code of Criminal Procedure by the Family Court, Mumbai.

The Family Court has directed the husband to pay a sum of Rs.5,000/- per month to the wife towards the maintenance. However, the Family Court did not consider the ratio laid by the Supreme Court in the case of Rajnis V/s. Neha reported in (2021) 2 SCC 324. The Family Court granted maintenance from date of the order.

In order to show his bonafide petitioner husband will deposit of Rs.20,000/- in the bank account/online payment to Respondent within a period of two weeks from today. Amol D. Nawale
