Learned counsel for the applicants submits that as per the impugned order the applicant no.1. is regularly paying maintenance for the minor daughters. She further submits that applicant no.1's petition for divorce has been dismissed and the First Appeal is also dismissed. She further submits that the Second Appeal (St) No. 17767 of 2024 is filed challenging dismissal of the divorce petition. 2.

Learned counsel for the applicants further submits that considering nature of the dispute between the parties, applicants are agreeable to amicably settle the dispute with respondent no. 1. by RAJESHWARI RAMESH PILLAI Date:

In view of the peculiar facts of the case, issue notice to respondent no. 1 returnable on 10th September 2024. Notice to indicate that the application will be disposed of finally at admission stage. In addition to court notice, applicants to serve respondent no.1 by private service and file service affidavit before the next date. 4.

The statement made on behalf of the applicants that the applicant no. 1 is regularly paying maintenance for the minor daughters and shall continue to pay maintenance for the minor daughters is accepted as an undertaking to the court. [GAURI GODSE, J.] 2/2
