The learned counsel for applicant submits that the matter is settled out of the court, and Respondent No. 2 has received Rs.4,70,000/-

This court inquired with the applicant and Respondent No. 2 present in the Court, both submit that the matter is settled out of the Court and agreed to their signatures on the consent terms. 4.

In view of the submissions of learned counsel for the applicant and Respondent No. 2 party in person, and the consent terms, I pass following order.

ORDER

i) The impugned order dated 06/.07.2024 passed by Hon'ble Sessions Court at Dindoshi Branch, Mumbai in Criminal Appeal No. 174 of 2018 in C. C. No. 26/SS/2006, is quashed and set aside. ii) The applicant is acquitted for the charges of under section 138 of NI Act.

iii) All pending applications are disposed of.

The Revision Application is allowed in above terms and disposed of.
