In fact the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act are not invoked, but due to misunderstanding that submission was made on 09/09/2024. In fact the present Applicant alongwith other, they are charge-sheeted for offences only under Indian Penal Code, however their discharge application was rejected by the Court of Additional Sessions Judge. P2-REVN 510 of 2024.doc for the reason that charge-sheet against them is counter case and the charge-sheet instituted on their complaint involved an offence under Scheduled Caste and Scheduled Tribes Act. That is why their case is transferred, and discharge application was dealt with by the Sessions Court.

By this Order the factual aspects are clarified. The operative order will remain same.

Let the amendment permitted on 09.09.2024 be carried out within three days period.
