For the reasons recorded separately, following Order is passed : (i) The Appeal is thus allowed.

(ii) The judgment and order dated 22nd January 2024 in Sessions Case No. 9 of 2020 passed by the learned District and Addl. Sessions Judge, Karad, convicting the Appellant for the osk 1 of

J-APPEAL-208-2024 (Operative Part).doc offences punishable under Section 302 of I.P.C. and consequently, sentencing him to suffer imprisonment for life is hereby set-aside.

(iii) The Appellant stands acquitted of the offence punishable under section 302 of I.P.C..

(iv) Fine amount, if paid, be refunded to the Appellant immediately.

(v) The Appellant shall be set at liberty forthwith, if not required in any other case.
