Learned APP waives service on behalf of the State. INTERIM APPLICATION NO. 1309 OF 2024 4.

This is an application for suspension of the sentence imposed by the trial Court vide judgment and order dated 23/02/2024 and bail.

The First Information Report bearing C.R. No. 523 of 2017 dated 25/11/2017 is registered with Akkalkot North Police Station, Solapur. The appellants are convicted by the

trial Court for the offences punishable under Sections 143, 147, 148, 324 and 323 read with 149 of the Indian Penal Code. The maximum sentence imposed is three years of rigorous imprisonment and fine. The fine amount has been paid.

Learned APP opposed the appeal and submitted that the trial Court had convicted the appellants upon appropriate appreciation of the evidence.

The appeal is unlikely to be heard any time soon. The appellants were on bail during the trial. Considering the short sentence and as there is nothing on record to indicate that the appellants have misused their liberty during the trial, the appellants are enlarged on the same bail as in the trial Court but with fresh bonds.

The appellants shall furnish their contact numbers and residential addresses to the Investigating Officer and shall keep him updated, in case there is any change. 9.

The appellants shall attend the trial Court, once a year, on the first Monday of the concerned month, between 11.00 a.m. and 1.00 p.m. commencing May 2024.

The interim application stands disposed of.
