CORAM : M. S. KARNIK, J.
DATE : APRIL 17, 2024 P.C. :
1.
Heard learned counsel for the appellant.
2.
This is an appeal challenging the order dated 26/03/2024 passed by the Sessions Judge, Kalyan rejecting the anticipatory bail application of the appellant in connection with the offences punishable under sections 363, 511, 504, 506 of the Indian Penal Code, 1860 and under sections 3(1)(z) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 registered vide C.R. No. 203 of 2016 with Khadakpada police station. 3.
The trial Court was of the opinion that the application 1/3
itself is not maintainable as on the earlier occasion, anticipatory bail application was rejected and therefore entertaining the application would amount to review of the order. From the FIR it appears that allegations are mainly against the appellant's husband. The appellant's husband is the landlord of the premises where the informant is residing. Learned APP to take instructions.
1.
Issue notice to the respondent no.2, returnable on 07/05/2024. Learned APP waives service of notice on behalf of the State.
4.
In the meantime, the appellant needs to be protected by an interim order.
5.
In the event of arrest of the appellant- Manisha W/o Padmakar Patil in connection with C.R. No.203 of 2016 registered with Khadakpada police station, the appellant shall be released on bail on her furnishing P.R. bond in the sum of Rs.10,000/- with one or more sureties in the like amount.

when called.
