Mr. D'souza, appearing for the Appellant who is appointed through Legal Aid submits that on the day on which the Complaint was dismissed for non-prosecution on 20 March 2024, the Appellant was in fact pursuing Writ Petition No.1264 of 2020 before this Court for expeditious decision of the said Complaint. That on the same day i.e. on 20 March 2024, this Court in fact directed expeditious decision of the Complaint and the Appellant later realized that the Additional Sessions Judge had actually dismissed the Complaint for non-prosecution on 20 March 2024.
